Terms of Use
Effective October 22, 2026
1. Agreement
These Terms of Use ("Terms") are an agreement between you and the team that publishes Capy ("Capy", "we", "us"). They cover the Capy desktop app for macOS, Windows and Linux, its updates, and this website (together, the "Services"). By downloading, installing or using the Services you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Services.
2. What Capy is
Capy is a peer-to-peer meeting room. People join a room by invite, chat, call with voice and video, share files and screens, and get transcripts, minutes and speaking insights made on their own computers. There are no accounts and no server of ours that can read your rooms: they live on the devices of the people in them and travel between those devices, directly whenever they can, or through a relay that can't read them.
Capy is in beta. Features may change, break or go away, and data may be lost. Keep your own copies of anything that matters.
3. Who can use Capy
You must be at least 16 years old, or the age of digital consent where you live if it is higher, and able to agree to these Terms. If you use Capy for an organization, you agree to these Terms for it and confirm you may do so.
4. Your identity and your 24 words
Capy has no sign-up. Your identity comes from 24 recovery words that only you hold.
- Anyone who has your words can be you on Capy. Keep them private and offline.
- We never see your words and cannot recover, reset or replace them. If you lose them and every device that knows them, your identity and its rooms can't be brought back by anyone.
- You are responsible for everything done with your identity and on your devices.
5. How peer-to-peer works, and its limits
When you use Capy, your device connects directly to other people's devices over a public peer-to-peer network. That has consequences you accept by using it:
- The people in a room keep a copy. Messages, files, transcripts and minutes are stored on every member's device. Anyone in a room can read, save, screenshot or record what is shared there.
- Deleting is best effort. "Delete for everyone" removes a message's key from every device running an honest copy of Capy, but someone who already saved, copied or photographed it keeps it, and a modified app may ignore the delete.
- Your devices must be reachable. Rooms sync only while members are online, or while our blind peer keeps an encrypted copy. We don't promise any room will be available at any time.
- Others can see your network address. Peers you connect to, nodes of the network, and our blind peer and relay when they're used, can see your IP address (see the Privacy Policy).
- Secure rooms reduce, not remove, risk. They hold 2 to 8 people, keep their key in a file on each member's device until the room is erased, keep nothing but the chat and are erased when their call ends (by default), when their time is up, or when the owner erases them. Someone in one can still photograph their screen.
6. Your content
You own what you share in Capy. You give the other members of each room the permission they need to receive, store, show, transcribe and summarize it through Capy, as the app does. We don't receive your content and claim no rights to it.
You are responsible for your content and for having the right to share it.
7. Recording, transcription and consent
Capy can transcribe calls and write minutes on each participant's computer, and you can record voice and video messages. Laws about recording and transcribing conversations differ by country and may require everyone's consent. You are responsible for telling the people in your calls and getting any consent the law requires before you transcribe, record or summarize them.
8. Acceptable use
Don't use the Services to:
- break the law or help someone else break it;
- share sexual content involving minors, or content that exploits or endangers anyone;
- harass, threaten, stalk, defame or impersonate anyone;
- share content you don't have the right to share, or infringe anyone's intellectual property or privacy;
- send malware, spam or anything meant to harm devices or data;
- attack, overload, probe or disrupt the network, other people's devices, the blind peer, the relay, update seeders or our feedback inbox, or get around Capy's protections;
- collect other people's data without their consent.
Because we can't read rooms, we can't see or moderate them. Room owners and admins can remove people and delete messages, and moderators can delete messages.
9. On-device AI
Transcripts, captions, translations, minutes, tasks and answers are produced by AI models running on your computer. They can be wrong, incomplete or attribute words to the wrong person. Check them before relying on them, and never use them as the only basis for medical, legal, financial, employment or safety decisions. The models are downloaded from the QVAC model registry over the peer-to-peer network and are covered by their own licenses.
10. Software license and open source
Capy's source code is licensed under the Apache License 2.0. It includes third-party open-source components under their own licenses. These Terms don't grant you any right to use the Capy name, logo or capybara artwork except to refer to Capy.
11. Updates
Capy updates itself over the peer-to-peer network from peers that seed new versions. Updates may add, change or remove features. Older versions may stop working with newer ones.
12. Feedback
If you send feedback, ideas or bug reports, you let us use them freely to improve Capy, without any obligation to you.
13. Price
Capy is free. If we ever offer paid features, we will present their terms before you buy anything.
14. Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, non-infringement, availability, security or accuracy, to the fullest extent allowed by law. We don't control the peer-to-peer network, other people's devices or what other people do with what you share.
15. Limitation of liability
To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, content, profits or goodwill, arising from the Services. Our total liability for any claim is limited to the greater of what you paid us for the Services in the twelve months before the claim, or 50 US dollars. Some places don't allow these limits, so they may not apply to you.
16. Indemnity
You agree to defend and hold us harmless from claims arising from your content, your use of the Services or your breach of these Terms, to the extent allowed by law.
17. Ending your use
You can stop using Capy at any time: log out to make a device forget your words, remove devices in Settings → Devices, and uninstall the app. Copies other members already hold stay with them. We may stop publishing updates or operating the blind peer, the relay or the feedback inbox at any time.
18. Governing law
These Terms are governed by the laws of the place where the team that publishes Capy is established, without regard to conflict-of-law rules. Nothing here takes away rights you have under the consumer protection laws of the country where you live.
19. Changes
We may update these Terms. We will change the date at the top and, for important changes, tell you in the app or on this website. Using the Services after a change means you accept it.
